SUPREME COURT QUASHES FIR IN KOOTHUPARAMBA POLICE FIRING CASE
The First Information Report (FIR) filed against Minister M V Raghavan, the then Dysp Hakkim Battery, Thalassery sub collector T T Antony, ASP Ravita Chandrasekhar and 14 other policemen in the Koothuparambu case was cancelled by the Supreme Court thus making the case non-existent. But the court asserted that the FIR made immediately after the incident will stay and more accused can be added if situation demands. Justice Muhhamed Kadiri and Justice S N Fukano pronounced this important judgement.
Kannur SP Padmakumar and Thalassery ASP Ravita Chandrasekhar had prepared two FIR's immediately after the incident. But those two were cancelled, as they never had any similarities and the a third FIR made was questioned by the court.The Koothuparambu police firing took place in Nov 25,1994. The CPM government, which came to power in 1996, ordered a reinvestigation by Justice Padmanabhan Commission. This inquiry found that M V Raghavan, Hakkim Battery and other 14 policemen were involved in the case. It was widely accused that these findings were politically motivated. The Kerala High Court acquitted Ravita Chandrasekhar from the case and Kerala government moved to the Supreme Court. 14 policemen accused in the case requested the Supreme Court to acquit them, as their senior was acquitted. These two petitions were taken up by the court and made this very important decision.
